This rulemaking is referred to as the Solid Waste Capital Assistance Program Rule.

The MPCA amended Minnesota Rules chapter 9210 on solid waste grant and loans programs, which establishes a program to encourage and assist cities, counties, solid waste management districts, and sanitary districts in the development and implementation of solid waste management projects and to transfer the knowledge and experience gained from such projects to other communities in the state. The amendment specifically affects Minn. R. 9210.0100 to 9210.0200, relating to the grant application process for the solid waste management capital assistance program.

The amended rule implements legislative changes to the Solid Waste Capital Assistance Program included in 2023 Laws of Minnesota, chapter 60, article 3, sections 9 to 13, which increased the total amount of grant assistance for a project from $2 million to $5 million and expanded the activities that are eligible for funding to include reuse, recycling, composting, and resource recovery.

Background

The Solid Waste Processing Facilities Capital Assistance Program (CAP) provides financial and technical assistance to local governments to encourage investment in the proper management of solid waste. CAP has provided over $100 million to assist more than 100 projects in Minnesota since 1985.

The program objective is recovering materials and energy from waste and minimizing land disposal of municipal solid waste (MSW) through waste reduction, reuse, recycling, composting source-separated materials or yard waste, resource recovery, waste separation, and waste processing.
