The Minnesota Pollution Control Agency is planning a new rule governing waste. The main purpose is to adopt new rules to implement and govern regulation of the Packaging Waste and Cost Reduction Act (PWCRA) (Minn. Stat. § 115A.144-115A.1463).
The MPCA anticipates establishing this rule under Minnesota Rules, chapter 7035.
Background
The Packaging Waste and Cost Reduction Act (Minn. Stat. § 115A.144-115A.1463) placed new requirements on producers, registered producer responsibility organizations, markets for covered materials, public and private waste reduction, reuse, recycling, and composting service providers and facilities.
Producers will be organized under registered producer responsibility organizations to manage covered materials (including packaging and paper products, as defined in the law). The PWCRA also ensured materials go to responsible markets and will provide partial reimbursement for the cost of collection, sorting, handling, and otherwise managing covered materials for refill, reuse, recycling, and composting.
The PWCRA rule will aim to clarify definitions, exemptions, collection lists, statewide requirements and measurement, the stewardship plan and annual reports, and other topics that come up, as time allows.
The packaging extended producer responsibility advisory board has been established to review activities conducted by the MPCA and the producer responsibility organization. They will also advise on program implementation.
