In 2021, the MPCA adopted Minn. R. 7023.0150-7023.0300 (also known as the Clean Cars Minnesota rule) to help address climate change and protect the health of Minnesotans. The rule included low emission vehicle standards for particulate matter, nitrogen oxides, non-methane organic gases, and greenhouse gases, and the zero emission vehicle (ZEV) standard. Battery electric and plug-in hybrid electric vehicles are considered ZEVs.
After significant progress in electric vehicle adoption due to the Clean Cars Minnesota rule, the MPCA declared the rule obsolete with the end of the automobile industry's 2025 model year. Automobile manufacturers must still fulfill the MPCA's reporting requirements for the 2025 model year.
Data reporting for ZEV credits
The Clean Cars Minnesota rule provided two mechanisms for manufacturers to populate an initial ZEV credit bank:
- Voluntarily earn early-action credits (Minn. R. 7023.0300, subp. 4)
- Onetime allotment of credits (Minn. R. 7023.0300, subp. 5)
To receive the credits, manufacturers must have provided data to the MPCA on Minnesota vehicle deliveries.
Early-action credit reporting
Manufacturers could choose to earn early action credits for the ZEVs they delivered for sale in Minnesota from model year 2022-2024. Reporting for early-action credits was due on May 1, 2025.
One-time credit reporting
The MPCA also granted each manufacturer a one-time allotment of credits equal to that manufacturer's 2025 model year ZEV credit requirement. Manufacturers must have submitted their data on light-duty vehicle deliveries for model years 2021, 2022, and 2023 to allow the MPCA to calculate the requirement.
Submitting data
Model year 2025 is the first effective model year for the Clean Cars Minnesota regulations. Manufacturers have reporting requirements under both the Low-Emission Vehicle Standards (LEV) and Zero-Emission Vehicle Standards (ZEV) programs.
Data for the initial ZEV credit banks were submitted using the reporting spreadsheet provided at the link below. For the required LEV reports for MY 2025, manufacturers should submit their reports to MPCA using the same format as used to report to CARB. ZEV sales should be reported directly to the Zero Emission Vehicle Credit Reporting and Tracking System (ZEV CRDTS) as was done for MY 2024. In addition to the ZEV sales reported to ZEV CRDTS, a list of VIN must be submitted to MPCA. The VIN Report Form included in the link below may be used.
