The MPCA has rolled out its new online service for solid waste permits and approvals. Content on this page is tied to that service.

Major modification

A major modification is any change in a permit that may result in allowing an actual or potential increase in the emission or discharge of a pollutant into the environment, or that may result in a reduction of the agency's ability to monitor the permittee's compliance with applicable statutes and rules.

Since a major modification will include the revision of at least one facility plan, all updated plans must be submitted with the major modification application.

Minor modification 

A minor modification is defined in Minnesota rules as any of the following changes:

  • correct a typographical error
  • a provision in the permit that will not result in allowing an actual or potential increase in the emission or discharge of a pollutant into the environment, or that will not result in a reduction of the agency’s ability to monitor the permittee’s compliance with the applicable statutes or rules
  • expected year of closure
  • schedule for final closure
  • list of equipment in the contingency action plan
  • emergency contractors in the emergency response plan
  • construction schedule for opening and closing approved phases in the phase development plan
  • monitoring frequencies

Change of ownership

A permit modification is required when there is a change to the activity owner, landowner, and/or operator. If the modification is solely for the change of ownership, the permitting process will include a notice to local units of government and will not include certain steps required by the typical permit process for an issuance, reissuance, or major modification. 

The application for a change of ownership must include a binding written agreement between the permittee and the proposed transferee containing a specific date for transfer of permit responsibilities and allocation of liabilities between the permittee and the proposed transferee.
