Global: New online service for solid waste permits

The MPCA will soon be rolling out a new online service for solid waste permits and approvals. Content on this page is tied to that service and may not yet be completely operational.

Certain types of permits and approvals do not require an application to conduct solid waste activities. Instead, a notification to the MPCA of the intent to perform the specified solid waste activity is required. Although an application is not required, the owner, operator, or landowner must still follow all applicable solid waste rules and regulations outlined in Minnesota state rules and statutes. It is the responsibility of the permittee to be aware of these requirements.

Permit by rule

A permit by rule (PBR) means a facility or activity meets the requirements outlined in Minnesota rules and is deemed to have obtained a solid waste management facility permit without making application for it. Specific types of demolition debris disposal, energy recovery facilities, recycling facilities, transfer stations, and yard waste compost sites are covered by permit-by-rule provisions, as outlined in the Permit-by-rule (PBR) tab. 

You must notify the MPCA before conducting activities covered by a PBR. The forms used to notify the MPCA are provided in the in the Permit-by-rule (PBR) tab, along with general information and guidance associated with each activity.

General permit for concrete burial

A general permit is issued to a category of permittees whose operations, emissions, activities, discharges, or facilities are the same or substantially similar. This specific general permit is for the disposal of uncontaminated concrete. To be eligible for coverage under this General Permit, the uncontaminated concrete must originate from a demolition on the site where the disposal is to occur. 

To obtain coverage under this permit, the owner(s) must submit a complete application through the MPCA’s Solid Waste Permitting & Approvals Online Service. The online service provides forms and certifications to document compliance with the necessary criteria for coverage under this general permit, prior to disposal of the uncontaminated concrete. To be complete, the online service application must be signed by the County Solid Waste Official. Coverage under this permit commences upon the owner’s receipt of the notice of coverage issued by the MPCA. Following the effective date of coverage, the Permittee(s) may dispose of uncontaminated concrete in compliance with the terms of this general permit for 12 consecutive months or until the expiration date of this permit, whichever comes first. 

The MPCA reserves the right to issue an individual permit for disposal of uncontaminated concrete where the disposal would be more appropriately regulated by an individual permit.

Waste tire transporter

A waste tire transporter removes waste tires from a waste tire generator, tire dump, or waste tire facility and delivers the waste tires to another waste tire facility. The facility receiving the waste tires must have a permit or received explicit written approval by the state in which they are located to process, transfer, or store the waste tires unless the business is exempt from any permit requirement related to waste tires. 

The individuals and businesses that are approved waste tire transporters have been granted a Waste Tire Transporter Identification Number by the MPCA. Persons who wish to dispose of waste tires may only have them collected by an MPCA-approved Transporter and should verify in advance that the Transporter is approved by asking to see the MPCA identification card or calling the MPCA. Termination

Once a facility is closed and the PBR, GCB, or waste tire transporter authorization is no longer needed, a termination must be requested via the MPCA's e-Services.
