Proposed Changes to Clean Water Partnership Rules

The goal of amending the Clean Water Partnership Rules is to address recent changes to Minn. Stat. 103F as provided by Laws of Minnesota for 2011 (pp 21-26).Exit to Web The Clean Water Partnership Rules (Chapter 7076) have not been amended since 1995 and MPCA is also considering changes to streamline rule requirements based on current MPCA water quality objectives. Changes may include housekeeping changes to address obsolete requirements, elimination of noncompetitive continuation grants, and funding changes from advance payments to expense reimbursement, as well as other changes necessary to streamline and update existing requirements. MPCA anticipates this effort will simplify and streamline the rules.

Stakeholder engagement

A videoconference is scheduled for Friday, February 3, 2012, from 9 AM to noon in the Saint Paul central office and MPCA regional offices in Brainerd, Detroit Lakes, Duluth, Mankato, Rochester and Willmar. MPCA staff will provide an overview of the rule revision process, present preliminary changes to the rule and provide an opportunity for stakeholders to comment on the CWP rule. When available, the preliminary draft will be uploaded to the CWP rule web page. Check the "Rule related documents" section of this web page. The goal is to make the preliminary draft language available on or before January 31, 2012.

The 1/11/13 hearing has been cancelled as no requests for a hearing or comments were submitted.  MPCA will proceed with processing relevant paperwork to adopt the rule.

Notice(s)

The intent of the RFC is to raise awareness that MPCA has initiated rulemaking to amend existing rules for a specific purpose. The RFC is required under the Administrative Procedures Act to notify interested and affected parties so they can begin participating as stakeholders in the rulemaking process. The timeline is determined by administrative law, but in general, rulemaking projects take 18 months to five years to complete. We expect this rulemaking to be completed within 2 years, given the fact that this rulemaking is to supplement existing rules rather than create a new program.

The RFC is only the first opportunity for you to get involved in the process.  Future opportunities include:

  • Send the rule team members an e-mail before the Dual Notice is published, to share your thoughts or to be on the mailing list. E-mails work better than phone messages since they can be disseminated to all the rule staff in your own words, and be preserved for the record.
  • Attend the informational stakeholder meeting and provide comments.
  • Provide written comments to the MPCA after the formal publication of proposed rules and the Statement of Need and Reasonableness, followed by attendance at public hearings, if required.
