MPCA Enforcement Actions Total Over $500,000 in Second Quarter of 2009

Contact: Stephen Mikkelson, 218-316-3887, 800-657-3864 St. Paul, Minn. -- The Minnesota Pollution Control Agency (MPCA) concluded 77 enforcement cases totaling $501,842 in penalties during the second quarter of 2009. The cases occurred at facilities in 36 counties throughout Minnesota. The following is a brief summary of the 77 cases completed during the second quarter of 2009.
--$35,000 - 22 LLC, for asbestos violations at Garden City.
--$30,000 - Minnesota Department of Transportation and Valley Infrastructure Group LLC, for stormwater violations at Chaska.
--$28,000 - Industrial Finishing Services, for water quality and hazardous waste violations at New York Mills.
--$25,000 - City of Belle Plaine and Heselton Construction LLC, for stormwater violations.
--$20,000 - City of Baxter and Tom's Backhoe Service Inc., for stormwater violations.
--$20,000 - Minnesota Department of Transportation and Ames Construction, for stormwater violations at Long Lake.
--$18,000 - Minnesota State Colleges and Universities, for hazardous waste violations at Hibbing Community College and other locations.
--$15,000 - Diamond K Dairy Inc., for feedlot violations at Altura.
--$13,300 - City of Minneapolis Water Works, for water quality violations at Fridley Dewatering Plant.
--$13,200 - EnviroTech Remediation Services Inc., for asbestos violations at South St. Paul.
--$10,000 - Fitzgerald Excavating & Trucking Inc., for solid waste violations at Goodhue.
--$10,000 - University of Minnesota, for water quality violations at TCF Bank Stadium in Minneapolis.

--$ 690 - Jason Tipton, for individual septic treatment system violations at Goodhue. The penalties for the following cases were forgiven. In cases where there are no serious or repeat violations, the penalty must be forgivable if the specified corrective actions are completed within 30 days. This offers the regulated party a chance and motivation to correct problems without paying a monetary penalty.
